Major Setback for City, Mayor Reed in Measure B Litigation

The entire City of San Jose workforce earned a major victory last week in the Measure B litigation, as the presiding judge over the consolidated pretrial motions ruled against the City in its attempt to dismiss several challenges by two Unions to the Mayor’s unlawful pension reform scheme. Measure B was a City ballot measure that unlawfully modifies pension benefits for city employees

The City filed numerous and costly motions seeking to dismiss several causes of action in the AFSCME and POA lawsuits. By denying the City’s claims in favor of the Unions’, the judge found ample evidence that the law could support a decision in favor of the Unions. The Local 21 lawsuit was not challenged.

We are awaiting a pre-trial conference later in February when dates for the trial will hopefully be decided.
